What Is Marital Property?

Marital property is any property acquired by the spouses through work during the marriage or derived from such property.

It commonly includes:

What Is Not Marital Property?

Personal property is excluded from marital property. This typically covers:

  • assets acquired before marriage,
  • inheritance or gifts received by one spouse only,

How Is Marital Property Divided?

The starting point is that marital property is divided equally, regardless of formal ownership or whose name is on the title.

Example: An apartment purchased during marriage in the name of one spouse is still considered joint property and is typically split 50/50.

Marital Agreement – Regulating Property in Advance

Spouses may sign a marital property agreement (prenuptial agreement) defining what belongs to marital property and what remains personal property. The agreement must be in writing and notarized.

Resolving Disputes Over Marital Property
